II. GENERAL PROVISIONS
2.1. These Terms and Conditions apply to all passenger road transport services provided by the Provider. Any departure from these Terms and Conditions in an individual case requires a written agreement between the Provider and the Customer.
2.2. These Terms and Conditions are binding on the Customer from the moment they enter into a legal relationship with the Provider.
2.3. The Customer has a contractual relationship exclusively with the Provider and under no circumstances with any other person engaged by the Provider to transport the Customer.
III. OBLIGATIONS OF THE PROVIDER
3.1. The Provider undertakes:
a.) if an order is confirmed, to collect the person/persons at the Pick-up Location and arrange their transport to the Destination;
b.) if unable to attend the Pick-up Location, to inform the Customer without further delay and agree on the next steps.
3.2. Unless a written contract has been signed between the Customer and the Provider, their legal relationship arises when the Provider accepts the Customer’s order. At that moment, the Provider becomes obliged to arrange transport for the person/persons and the Customer becomes obliged to pay for the transport in accordance with these Terms and Conditions and the Provider’s Price List.
3.3. The Provider may fulfil its obligation through another provider, and the Customer agrees that the Provider may use any third party to fulfil that obligation and may therefore subcontract all or any part of the transport and other services on terms determined by the Provider.
IV. OBLIGATIONS OF THE CUSTOMER
4.1. The Customer undertakes:
a.) if wishing to use the Provider’s services, to order transport in the prescribed manner, i.e. by telephone, electronically (email), or through the online form;
b.) to state their name, email address and telephone number in the order; if a Customer code has been assigned, stating that code alone is sufficient; a Customer code means the customer number of a regular Customer; the order must also include the address of the Pick-up Location, the pick-up time and the Destination;
c.) to provide the Provider with correct details of the Pick-up Location and the exact pick-up time; if this obligation is breached, the Provider is not liable for failing to arrive at the Pick-up Location on time.
V. PASSENGER TRANSPORT
5.1. The Provider’s obligation to transport the person/persons is fulfilled by delivering the Customer to the Destination.
VI. TRANSPORT PRICES AND PAYMENT TERMS
6.1. The Customer is obliged to familiarise themselves with the Provider’s current Price List, which is available through a publicly accessible information system (the Internet).
6.2. For transport under these Terms and Conditions, the Customer is obliged to pay the price in the Provider’s current Price List, unless otherwise specified in writing.
6.3. The transport price may be paid in cash in the vehicle or by cashless payment:
a.) on the basis of an invoice — the Provider’s tax document — payable within 14 days of its issue;
b.) by Visa or Mastercard, including payment by credit card using the driver’s payment terminal.
6.4. Fees invoiced by the Provider to the Customer under these Terms and Conditions or the Provider’s Price List.
VII. COMPLAINTS AND ORDER CANCELLATION
7.1. If the Customer discovers shortcomings in the quality or scope of the services provided, they have the right to make a complaint about those shortcomings. Complaints must be raised without undue delay after discovering the shortcoming, and no later than 10 days after the transport took place.
7.2. A complaint under the preceding paragraph must be in writing or electronic form, must contain an exact description of the damage caused, and must be delivered to the Provider within the time limit stated in the preceding paragraph.
7.3. If the Customer does not assert their claims within the period and in the manner specified in this article, the transport is deemed to have been performed properly and on time.
7.4. Complaint-handling procedure:
7.4.1. If a complaint cannot be resolved immediately, a complaint record must be drawn up with the Customer and signed by the Customer and the carrier authorised to do so.
7.4.2. The Customer is obliged to provide truthful information concerning the complaint about shortcomings in the service provided, as well as the cooperation necessary to handle the complaint.
7.4.3. An appointed employee or another person authorised to handle the complaint will decide whether the complaint about shortcomings is justified immediately, or within three working days in complex cases.
7.4.4. The Provider is obliged to inform the Customer in writing of the status of the complaint no later than 30 days after it is submitted, i.e. after receiving the supporting documents from the Customer. This mainly concerns shortcomings that require expert assessment of the complaint.
7.5. If the Customer cancels the order more than 6 hours before the scheduled service, no cancellation fee will be charged. In the case of an online payment, the amount will be refunded in full to the Customer’s account under this provision.
7.6. If cancellation takes place less than 6 hours before the scheduled service, the Customer will be charged a fee of 100% of the price of the ordered service.
7.7. The Provider reserves the right to assess a cancellation request individually if the Customer cancels less than 6 hours before the scheduled service.
VIII. RELATIONSHIP TO SLOVAK LEGISLATION AND COURT DISPUTES
8.1. All legal relationships arising between the Provider and the Customer are governed by the laws of the Slovak Republic. Matters not regulated by the contract or these Terms and Conditions are subject to the relevant provisions of the Commercial Code.
8.2. Authentic wording of the Terms and Conditions and their relationship to differing statements or documents.
8.3. These Terms and Conditions take precedence over any differing statements made by persons acting on behalf of the Provider, unless such a differing statement is made in writing and signed by a person authorised under the relevant legislation to act on the Provider’s behalf.
8.4. These Terms and Conditions apply only where a written contract does not provide otherwise.
8.5. These Terms and Conditions are published in a publicly accessible information system with remote access (the Internet) on this website. In the event of a conflict between a written copy of the Terms and Conditions and the version published in the publicly accessible information system (the Internet), the version published in that publicly accessible information system (the Internet) takes precedence and is the sole authentic version of the Terms and Conditions.
IX. PERSONAL DATA PROTECTION
9.1. On registration, the Customer provides the data necessary to identify them in the online system, enabling the necessary accounting operations to be performed and a tax document to be issued.
9.2. The Provider undertakes to handle and process the Customer’s personal data in accordance with applicable legislation, collecting it only for the purposes stated above and to improve its services.
9.3. By using the online system, the Customer agrees to the collection and use of information about them under the conditions stated above.
X. FINAL PROVISIONS
